The key to successful (i.e. financially efficient) management of a claim is the early appreciation of the true value of the client's position. Contracts should, at least, provide a relatively concrete starting point to the analysis. From there the risks posed by the claim, both in terms of risk of failure, likely damages recovery and costs, need to be assessed early and soberly.
Proceedings are to be avoided, if this is at all possible. An intelligent and balanced report on the facts and law is required to give the client the tools they need to make the right decision for their business.
